DOT Revises NEVI Guidance After Court Blocks Program Freeze

U.S. Transportation Secretary Sean P. Duffy has announced revised guidance for the National Electric Vehicle Infrastructure (NEVI) Formula Program. 

The updates include streamlined applications, which will provide states with more flexibility to facilitate the expansion of EV charging infrastructure. 

A federal court blocked an earlier move by the Trump administration to freeze the program, ruling that the Department of Transportation (DOT) had overstepped its authority and attempted to override the will of Congress. 

According to Transport Topics, the reforms to the NEVI program include minimizing state requirements linked to electric grid electrification systems and eliminating requirements associated with consumer protections and emergency evacuation procedures.  

Additionally, DOT is providing funding flexibility for roadway projects and streamlined rules and guidance surrounding the project-approval process. 

“If Congress is requiring the federal government to support charging stations, let’s cut the waste and do it right,” said U.S. Transportation Secretary Sean P. Duffy, in a statement. “The Biden-Buttigieg Administration failed to deliver EV chargers despite their promises. Our revised NEVI guidance slashes red tape and makes it easier for states to efficiently build out this infrastructure. While I don’t agree with subsidizing green energy, we will respect Congress’ will and make sure this program uses federal resources efficiently.” 

The Federal Highway Administration (FHWA) will manage the program and is soliciting public input specific to the new interim guidance. FHWA will modify the NEVI program based on public and shareholder feedback, asking for comments to be submitted this month.
